Terms of use

This product was purchased with either a Single User or Site License agreement. The appropriate terms and conditions (following) apply to the user and/or the user's institution ("the Licensee").
By using Social History of Christianity in South Africa, 1487 to 1994, produced by the University of Cape Town, Rondebosch, Cape Town, South Africa (UCT), the user and/or the user's institution accept the terms and conditions of the following License Agreement, which is a legal agreement between the user (an individual or a corporate entity) and UCT.

License Agreement: Single User

  1. The CD-ROM Product

    The "CD-ROM Product" is The Social History of Christianity in South Africa, 1487 to 1994 comprised of the CD-ROM data disc containing information developed and compiled at the University of Cape Town ("UCT") as follows:
    • Volume 1: Christianity and the Colonization of South Africa, 1652 to 1870, by Charles Villa-Vicencio; included are 186 selected archival documents in electronic format.
    • Volume 2: Christianity and the Modernization of South Africa, 1867 to 1936 by John W. de Gruchy; included are 151 selected archival documents in electronic format.
    • Volume 3: From Dark Days to Liberation: Perspectives on the Social History of Christianity in South Africa, 1936 - 1994, Special issue of the Journal for Theology in Southern Africa, Volume 118, March 2004.
    • An index of 5000+ documents from documentary archives linked to this research, which are lodged in the Manuscripts and Archives Department of UCT Libraries.
    • Original scanned formats of the 337 documents for Volumes 1 and 2.
  2. Grant of License

    1. UCT grants to the Licensee a non-exclusive, personal, non-transferable license to use the CD-ROM Product for educational and/or not-for-profit purposes, under the terms and conditions of this Agreement.
    2. All proprietary rights in the CD-ROM Product remain vested in UCT, its licensors and suppliers.
  3. Permitted Usage

    1. The CD-ROM Product may be used on a single-use microcomputer or terminal at the location specified on the order form ("Licensed Location").
      1. The CD-ROM Product may be moved to and used on another single-user microcomputer or terminal at the same Licensed Location.
      2. The CD-ROM Product may not be used on more than one microcomputer or terminal at the same time.
      3. The CD-ROM Product may be used on a multi-user network system, provided that use is limited to one simultaneous user at any given time.
    2. Copies of portions of the CD-ROM Product may be printed out, provided that:
      1. Such copies are used only for educational and/or not-for-profit purposes; and
      2. The source of the material copied is duly acknowledged.
  4. Restrictions on Use

    1. The CD-ROM Product may not be moved from the Licensed Location to any other location without the prior written permission of UCT.
    2. The Licensee may not make copies of the CD-ROM Product, nor transfer or distribute all or any part of the CD-ROM Product to other CD-ROMs or software storage devices, except that the software included in the CD-ROM Product may be copied for the purposes of:
      1. Installation on a hard disk drive as necessary to use the CD-ROM Product as permitted by this Agreement; and/or
      2. Backup.
    3. Under no circumstances may copies of the CD-ROM Product be made for access outside the Licensee's organization, for resale or for distribution in any media, and under no circumstances may any portion of the CD-ROM Product be transmitted or otherwise telecommunicated.
    4. The software programs contained in the CD-ROM Product may not be decompiled, disassembled or reverse engineered.
    5. The Licensee may not:
      1. Modify the material and/or data contained in the CD-ROM Product; and/or
      2. Prepare derivative works of the CD-ROM Product Without prior written authorization from UCT.
  5. Assignment

    This license is personal to the Licensee, and the Licensee may not sell, assign, transfer or sublicense its rights hereunder nor the tangible embodiments of the CD-ROM Product to any other institution or person without the prior written consent of UCT.
  6. Term

    1. This license will remain in effect for as long as the Licensee holds and uses the CD-ROM Product in accordance with this Agreement.
    2. If the Licensee fails to comply with the requirements of this Agreement and does not cure such failure to the satisfaction of UCT within fourteen (14) days after being notified by UCT, then UCT shall have the right to terminate this Agreement forthwith by giving notice to the Licensee. Upon termination, the Licensee will promptly return the CD-ROM Product (including any copies of any portion thereof) to UCT.
  7. Limitation of Liability and Warranty

    1. While UCT has no reason to believe that there are any errors or omissions in the information contained on the CD-ROM Product, UCT does not represent or warrant that the CD-ROM Product is free from error, and does not assume, and expressly disclaims, any liability to any person for any loss or damage caused by errors or omissions in the CD-ROM Product, whether such errors or omissions result from negligence, accident or any other cause.
    2. UCT warrants that the media on which the CD-ROM Product is provided will be free of defects upon delivery. If the Licensee receives a copy of the CD-ROM Product which is defective upon receipt, UCT will replace it at no additional charge, provided the defective CD-ROM Product is returned to UCT within sixty (60) days from the date of delivery.
    3. The Licensee understands that, except for the limited warranty recited in sub-clause 7.2 above, UCT and its licensors, suppliers or agents make no warranties, express or implied, with respect to the CD-ROM Product and specifically disclaim any warranty of merchantability or fitness for a particular purpose. Replacement for a defective CD-ROM Product is the exclusive remedy for breach of warranty under this Agreement. In no event will UCT, its licensors, suppliers or agents be liable for any damages whatsoever, including but not limited to any lost profits, or other incidental or consequential damages arising out of the Licensee's use or inability to use the CD-ROM Product.
  8. General

    1. This document contains the entire Agreement between UCT and the Licensee in respect of the CD-ROM Product, and no party shall be bound by any undertaking, representation or warranty not recorded in this Agreement or added to this Agreement as provided for in accordance with this Agreement. No preprinted terms or conditions, form or document presented by the Licensee, including but not limited to a purchase order, shall have any force or effect with respect to the subject matter of this Agreement.
    2. This Agreement shall be governed by the laws of the Republic of South Africa.
    3. If any clause or term of this Agreement should be invalid, unenforceable or illegal, then the remaining terms and provisions of this Agreement shall be deemed to be severable and shall continue in full force and effect.

License Agreement: Site License

    2. The CD-ROM Product may be used only by individuals who are authorized to access the Licensee's information technology services ("Authorised Users").
      1. The Licensee shall take appropriate measures to ensure that individuals who are not Authorised Users do not have access to the CD-ROM Product.
    3. Copies of portions of the CD-ROM Product may be printed out, provided that:
      1. Such copies are used only for educational and/or not-for-profit purposes; and
      2. The source of the material copied is duly acknowledged.
